These terms of use (the “Terms”) govern your access to and use of the website operated by Outpace Performance Ltd (“Outpace”, “we”, “us”, “our”), a company registered in England & Wales under company number 17364456, with its registered office at 124 City Road, London, EC1V 2NX, United Kingdom. By accessing or using this website (the “Site”), you agree to be bound by these Terms. If you do not agree to them, please do not use the Site.

1. Who we are

The Site is an informational website describing the consulting and lead generation services offered by Outpace. You can contact us about anything in these Terms through our contact page.

2. No professional advice

The content of the Site is provided for general information only. It does not constitute marketing, financial, legal, investment or any other form of professional advice, and it is not intended to amount to advice on which you should rely. Nothing on the Site takes account of your particular circumstances, and you must obtain professional or specialist advice before taking, or refraining from taking, any action on the basis of the Site’s content.

Your use of the Site does not create, and shall not be construed as creating, any client, advisory, fiduciary or other professional relationship between you and Outpace. Such a relationship arises only under a separate written agreement signed by both parties.

3. Use of the Site and acceptable use

  • attempt to gain unauthorised access to the Site, the server on which it is hosted, or any connected server, computer or database;

We may prevent or suspend your access to the Site if you do not comply with these Terms or any applicable law.

4. Intellectual property

Unless otherwise stated, we are the owner or the licensee of all intellectual property rights in the Site and in the material published on it, including all text, design elements, logos, marks and code. Those works are protected by copyright and other intellectual property laws and treaties around the world. All such rights are reserved.

You may view, download and print extracts from the Site for your personal, non-commercial reference, provided you do not modify them and you retain any proprietary notices. You must not otherwise reproduce, distribute, republish or exploit any part of the Site’s content without our prior written consent. Nothing in these Terms grants you any licence or right to use the “Outpace” name, wordmark or logo.

5. Third-party links

Where the Site contains links to other websites or resources provided by third parties, those links are provided for your information only. Such links should not be interpreted as approval or endorsement by us of those websites or of any information you may obtain from them. We have no control over the contents of third-party websites and accept no responsibility for them or for any loss or damage that may arise from your use of them.

6. Disclaimer

The Site and its content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Outpace excludes all conditions, warranties, representations and other terms of any kind which might otherwise apply to the Site or its content, whether express or implied, including without limitation any implied warranties or conditions of satisfactory quality, fitness for a particular purpose, non-infringement, accuracy, completeness or availability.

We do not warrant that the Site will be secure, uninterrupted or free from errors, defects, viruses or other harmful components, that defects will be corrected, or that the content is accurate, complete or up to date. We may suspend, withdraw, discontinue or change all or any part of the Site without notice, and we will not be liable to you if for any reason the Site is unavailable at any time or for any period.

7. Limitation of liability

To the maximum extent permitted by law, Outpace Performance Ltd, its directors and employees shall not be liable to you for any loss or damage of any kind, whether direct, indirect, incidental, special, consequential or otherwise - including, without limitation, any loss of profits, loss of revenue, loss of anticipated savings, loss of data, loss of business, loss of opportunity or loss of goodwill - arising from or in connection with your use of, or inability to use, the Site, or your reliance on any content displayed on the Site, whether such liability arises in contract, tort (including negligence), breach of statutory duty, misrepresentation or otherwise, even if such loss was foreseeable or we were advised of the possibility of it.

Where liability cannot lawfully be excluded but may be limited, our total aggregate liability to you in connection with the Site shall, to the extent permitted by law, be limited to the sum of one hundred pounds sterling (£100).

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under the law of England and Wales, including liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

8. Changes to these Terms

We may revise these Terms at any time by amending this page. The revised Terms apply from the moment they are published on the Site, and the “Last updated” date above will be changed accordingly. Please check this page from time to time, as your continued use of the Site constitutes acceptance of the Terms then in force.

9. General

If any provision of these Terms is found by a court of competent jurisdiction to be invalid or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect. Any failure by us to enforce any provision of these Terms shall not be a waiver of it.

10. Governing law and jurisdiction

These Terms, their subject matter and their formation (and any non-contractual disputes or claims arising out of or in connection with them) are governed by the law of England and Wales. You and we both agree that the courts of England and Wales shall have exclusive jurisdiction over any such dispute or claim.
